Your protections under Massachusetts law
These rules cover home improvement work on existing, owner-occupied homes with one to four units. They apply to any registered contractor, so use them to compare anyone you're thinking of hiring.
- A written contract. Work over $1,000 needs one, with the work, materials, total price and payment schedule (M.G.L. c. 142A, s. 2).
- A deposit limit. No more than one-third of the price, or the actual cost of special-order materials if that's higher. How the deposit rule works
- Time to cancel. If you sign at home, you have until midnight of the third business day to cancel in writing (M.G.L. c. 93, s. 48).
- Changes in writing. Any change to the contract must be written and agreed by both sides. What a good change order includes
- The state Guaranty Fund. If you win an award or judgment against a registered contractor and can't collect it, you can apply for up to $25,000 of your actual loss. It's for your primary home, and you lose this protection if you pull the permit yourself. Who qualifies
